The two faces of the right to own arms

Coluna Fictio Iuris

The right to own firearms is a contentious issue, with supporters arguing that it is a fundamental right protected by the Second Amendment of the United States Constitution, while opponents argue that it can lead to increased gun violence and should be more strictly regulated.

Proponents of the right to own firearms argue that it is a constitutional right that allows individuals to protect themselves, their property, and their families. They also argue that gun ownership is a way to preserve individual freedom and to resist tyranny. Opponents of the right to own firearms argue that it can lead to increased gun violence, including homicides, suicides, and accidental shootings. They also argue that there is no evidence that widespread gun ownership deters crime and that there should be stricter regulations on who can own guns and what types of guns can be owned.

Perhaps one of the most emblematic and unfortunate cases that occurred in the US that gave rise to a passionate debate on the right to own arms was the Columbine tragedy. Two senior students, Eric Harris and Dylan Klebold, carried out the attack, killing 12 students and a teacher, and injuring many others before taking their own lives. The two students had been planning the attack for over a year and had stockpiled weapons and explosives. They entered the school armed with guns, knives, and bombs, and began shooting students and teachers in the school's cafeteria, library, and classrooms.

The attack lasted for approximately one hour, during which time the police and SWAT teams arrived at the scene. The two students continued to shoot at officers and civilians, causing chaos and terror. The shooting finally ended when Harris and Klebold committed suicide in the school's library. The aftermath of the shooting was devastating for the families of the victims and the community as a whole. It sparked widespread debates on gun control, school safety, and mental health issues. The tragedy also prompted changes in law enforcement practices, school security measures, and counseling services to prevent such incidents from happening again in the future. Another more recent example is the shooting in Allen, Texas, in which the alleged murderer Mauricio García, a former security guard with an expired license since 2020, opened indiscriminate fire in a shopping center.

The debate between the right to arms as a premise of self-security and criticism of said prerogative has been alive for years, leaving unfortunate cases such as those exposed in which the right to arms represented the necessary prelude to commit atrocious crimes.

It's important to note that laws and regulations around the right to own firearms can vary significantly between countries, and even within different states or regions of a country. It's also a highly divisive issue that often prompts passionate responses from both sides of the debate.
